1) Please call and send e-mails to Senator Joan Huffman’s office and ask her to allow Senator Patrick to amend HB 732 which she is co-sponsoring in the Senate. She has refused thus far. Senator Patrick wants to amend some provisions from HB 3816 onto HB 732. These amendments would provide transparency of the TMB’s actions, ensure legal due process and protect patients’ and physicians’ rights.

The Texas House ran out of time last night and did not get to hundreds and hundreds of bills before the 12 midnight deadline for passing House bills this session. This means that we will have to use alternative routes to get the provisions of CSHB 3816 enacted by the legislature. We are now in the fourth quarter of the game!
We have been developing several other ways to accomplish this for the past several weeks in the event that we ran out of time in the House. So we are on to Plan B. We must continue to press the battle!
Please know that I remain confident that we will pass significant revisions to the Texas Medical Practice Act in the 2009 Texas Legislature.
Please continue to call your State Representatives and Senators and tell them that you want them to vote for legislation which revises the Texas Medical Practice Act.

The provisions of CSHB 3816 revise the Texas Medical Practice Act to prevent competitors, insurance companies, drug companies and hospitals from filing anonymous complaints against physicians. It prohibits conflicts of interest to prevent board members from working for insurance or other companies who are adverse to patients and physicians. It provides for transparency of the actions of the Texas Medical Board, ensures legal due process and protects patients’ and physicians’ rights from regulatory abuse.

Synopsis of the Provisions of C.S.H.B. 3816 which we are working to pass in the 2009 Texas Legislature
Eliminates anonymous and confidential complaints and provides the accused physician with a copy of the complaint (with narrow exceptions). This means that competitors, insurance companies, drug companies and hospitals can not file complaints against physicians without revealing their identity to the doctor subject to the complaint.
Abuse of the complaint process by insurance companies shall be grounds for imposing sanctions by the commissioner of the Texas Department of Insurance.
A reasonable time of 45 days to respond to complaints (currently the physician must respond in only 14 days, which is far too short for a defense).
Prohibition of conflicts of interests by TMB members.
Expert witnesses must be actively practicing medicine in the same or similar specialty as the accused physician, and the expert shall review the record with the patients’ and physicians’ identities redacted.
No more disregard by the TMB of expert testimony that exonerates physicians subject to complaints; such reports must be provided to the physicians.
Transparency by requiring disclosure of the list of names of persons who served on the ISC disciplinary panels during the prior year.
A seven-year statute of limitations on complaints to prevent the current practice of abusive complaints that go back as far as 29 years.
A physician may practice medicine in a manner currently taught by an accredited organization, and the Board may not direct a physician in how to practice medicine except to prevent actual harm or an imminent risk of harm.
Physicians may request the recording of the ISC disciplinary proceeding.
The Board must accept the findings of the administrative law judge or contest them in a legal proceeding, rather than ignoring them as the Board does now.
The Board shall not discipline a physician for allegedly non-therapeutic care unless it has a likelihood of harm to a patient.
Doctors, like attorneys, deserve a right to a jury trial before license revocation.

Physicians may request the recording of the ISC disciplinary proceeding.
The Board must accept the findings of the administrative law judge or contest them in a legal proceeding, rather than ignoring them as the Board does now.
The Board shall not discipline a physician for allegedly non-therapeutic care unless it has a likelihood of harm to a patient.
Doctors, like attorneys, deserve a right to a jury trial before license revocation.

We (Andrew Kotsanis, myself, Marge Woodard, Lamarque Polvado and Jon Gentry - from our camp) testified this past week before the Senate Committee on Health and Human Services on the same matter as we did April 14th in Austin. . . . .
It came out in testimony this past Tuesday that even the chairwoman of the Health and Human Services Committee (Jane Nelson - my senator) had no idea how bad the situation is. Also, according to the lawyer who is the executive director of the Texas Medical Board, there are currently complaints open on 6 autism doctors in Texas. It is ridiculous that virtually 100% of doctors who treat autism using nutrition and biomedical therapies have open complaints against them and they have no way of knowing their accusers. What is even more ridiculous is that mainstream doctors offer NO HOPE for this population. WHERE CAN THESE PATIENTS GO OTHER THAN INTO INSTITUTIONS? AND WHO WILL PAY FOR THAT?
Now that we have testified and been high profile about wanting reform, they are going after us. We need more support from people to call Senator Nelson's office and ask that the senate bill number 2336 include language that all complaints that are currently open should fall under the new law regarding knowing your acuser. Otherwise they will try and take out as many now as they can before the bill gets passed. Passage of some type of transparency seems highly likely. We also visited the governor's aide on Wednesday and implored him not to veto the bill.
If you know of anyone who can have the ear of House Public Health Committee members, Senate Health and Human Services Committee Members and any legislators in general, please ask them to help the bills pass (HB 3816 and SB 2336). It is so unfair for patients to be deprived of help.

Purpose: To address Texas Medical Boards actions limiting access to integrative and alternative physicians, persecution of doctors through abuse of power and targeting them with complaints. Greetings! Great news: HB 3816 was passed out of the House Public Health Committee on Tuesday, April 28, 2009 by a 10-1 margin. We could not have accomplished this without your efforts.
The companion bill is scheduled for a Senate Health and Human Services committee hearing this coming Tuesday, May 5th.
If you are in Houston, Please accept Dr. Hotze's invitation to travel to Austin to join him on Tuesday morning, May 5th, 2009 for the Senate Health and Human Services Committee Hearing on the companion bill to HB 3816. This bill will protect patients’ and physicians’ rights and provides for transparency of the Texas Medical Board (TMB) and legal due process for physicians.
We must ensure that both patients and physicians maintain their right to choose natural approaches to health care.

Greetings! Great news: HB 3816 was passed out of the House Public Health Committee on Tuesday, April 28, 2009 by a 10-1 margin. We could not have accomplished this without your efforts.
The companion bill is scheduled for a Senate Health and Human Services committee hearing this coming Tuesday, May 5th.
If you are in Houston, Please accept Dr. Hotze's invitation to travel to Austin to join him on Tuesday morning, May 5th, 2009 for the Senate Health and Human Services Committee Hearing on the companion bill to HB 3816. This bill will protect patients’ and physicians’ rights and provides for transparency of the Texas Medical Board (TMB) and legal due process for physicians.
We must ensure that both patients and physicians maintain their right to choose natural approaches to health care.
Buses will be provided for our guests and supporters. The buses will be leaving at 6:30 am sharp from the Carpool and Ride location on the Southwest corner of I-10 and Fry Road on Tuesday morning May 5, 2009. The buses will be back in Houston around 6:30 pm. Breakfast will be provided. Lunch will be available in the Texas Capitol cafeteria. You will also have time to meet your local legislators.
This is a tremendous opportunity for you to impact and influence legislation which will have a positive influence on your doctor’s and your ability to maintain freedom of choice in your health care. A strong show of support before the Senate Health and Human Services Committee will help us advance our goal to ensure that patients’ and physicians rights’ are protected in Texas.
